Are You Required to File a Form 5500 for Each of Your Health and Welfare Benefits?

The Form 5500 filing requirement applies to virtually every type of health and welfare plan, regardless of whether there are 10 participants or 500 participants, unless an exemption applies.  Many employers and brokers are either unaware of this requirement, or mistakenly believe that it does not apply to “small” plans with less than 100 participants.  The penalties for noncompliance are substantial, including up to $30,000 per year per missed filing.
